Content creator Azziad Nasenya has moved to the Commercial Court in Nairobi in a bid to stop the planned auction of her Kileleshwa apartment, a property she insists she legally owns and has already cleared all outstanding arrears for.
Court documents show that the popular TikTok star and influencer risks losing her home despite allegedly settling her loan with a deposit-taking savings and credit cooperative (Sacco) that financed her purchase through a mortgage arrangement.
According to Azziad, the financial institution has unlawfully initiated the process of recalling the full loan amount and instructed an auctioneer to dispose of the property, valued at approximately Ksh20.3 million, through what she describes as an “unlawful and premature process.”
Loan and Property Details
In her pleadings, Azziad explains that she became a member of the Sacco, making regular contributions that qualified her for a loan facility. Court filings note, “Consequently, the 1st Defendant prepared the charge dated June 12, 2024, over the Suit Property to secure the disbursement of the agreed amount to the vendor of the Suit Property.”
She further points out that the loan agreement included a clause protecting her from any early repayment demands.
“The court will note that recital ‘B’ of the charge expressly states that the 1st Defendant, as the chargee, would not call for, sue for, or require the repayment of the loan under the charge outside the time specified by the charge,” the documents read.
Azziad identified the Kileleshwa apartment in April 2024 as her desired residence and applied for financing from the Sacco. She was approved for a Ksh20,389,720 loan, formalized through a letter of offer dated April 4, 2024. The agreement was executed on April 16, and by June, the property had been charged as loan security and transferred to her name.
She began repaying the facility soon after and had, by the time of the dispute, paid Ksh897,924.68. Later, she fell behind because of economic challenges, and by September 2025, arrears were Ksh1.51 million.
Disputed Auction Notice
Azziad says the Sacco subsequently deducted Ksh2.45 million from her member savings on September 19, 2025, an amount that cleared all arrears in full. However, a few days later, she was shocked to see an auction notice published on September 24, 2025, indicating that her Kileleshwa apartment would be sold on October 8, 2025, over an alleged outstanding sum of Ksh21,881,979.35.
She states that the move to auction her home despite clearing the arrears is in breach of the mortgage contract and the legal charge registered against the property. She also accuses the Sacco of undervaluing her apartment by listing it as a three-bedroom instead of a four-bedroom unit, stating that such an error would lead to it fetching a lower price at auction.
Seeking Court Protection
Azziad contends that the defendants failed to issue the statutory notices required under the Land Act, making the planned auction illegal. The media personality now seeks a court declaration that she is not in arrears and that the auction notice issued on September 24, 2025, is “illegal, unlawful, and therefore null and void.”
She is also requesting a permanent injunction to restrain the Sacco and the auctioneer from selling or interfering with her property, in addition to damages for breach of contract and costs of the suit.
